Helpful Information About Applying For A Green Card Through Family

Two of the most common ways to obtain a green card through family are "consular processing" and "adjustment of status."
Consular Processing
  • Consular processing to get a green card requires the applicant to attend an interview at the US consulate, normally in their home country.
  • Consular processing often requires that the applicant apply for a waiver of prior unlawful presence by submitting Form I-601 or I-601A.
  • Consular processing normally takes significantly longer than adjustment of status.
Adjustment of Status
  • Adjustment of status to get a green card requires the petitioner and the applicant to attend an interview with the federal agency USCIS here in the United States.
  • To adjust status normally requires a showing that an applicant either (1) entered the United States lawfully, (2) has a son, daughter or spouse in the US Armed Forces and was granted "parole-in-place," or (3) was the beneficiary of an I-130 petition filed on or before April 30, 2001 (along with other requirements).
  • An applicant for a green card through adjustment of status may obtain a work permit by filing Form I-765 along with the adjustment application (Form I-485). However, an applicant for adjustment of status, unlike an applicant for adjustment of status, is not able to get a work permit while the process is pending.
